Michael Jordan Tells Court He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his drive to win and novelty within the sport motivated his push for 23XI Racing to confront Nascar over alleged violations of competition laws.
Team Investment and a Competitive Drive
Jordan shared operational insights of his 23XI team, revealing he invested $40m of his own funds into the Cup Series operation launched with business partner Curtis Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I had no fear. I believed I could take on Nascar in its entirety. I felt as far as the sport required examination from a different view.”
The Core Dispute: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 deal where Nascar granted each team a franchise. The concept is similar to other major leagues with separately owned franchises, such as the NBA’s Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on charter membership renewals.
Jordan testified for about sixty minutes and exited the courthouse to pandemonium, with onlookers and reporters vying for a view or a picture of the sports legend.
Leading the Legal Charge
23XI Racing is leading the full-court press along with another racing team for Nascar to change a operating model Jordan contended is breaking the law to maintain excessive control.
At issue for Jordan and a fellow team representative, who testified before Jordan, are events from last September. She recounted a frantic and emotional six hours where the racing circuit informed teams they had to sign a contract extension. The document consists of 112 pages detailing team compensation and a guaranteed spot in every race.
Choosing Litigation
Jordan explained that 23XI and Front Row Motorsports decided their only feasible option was to refuse a signature that 112-page package and litigate the matter. All other teams signed the agreement.
The team owners approached Nascar about possible changes or extension options. Nascar wasn’t talking, according to his testimony.
The Ultimate Motivation: Winning
Ultimately, the resistance against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Success.
“Denny convinced me getting a third driver boosted our odds of winning,” he testified, noting that he purchased another franchise last year for $28m despite the uncertainty. “So I took the plunge.”
Heather Gibbs’ Testimony
Gibbs described her push for indefinite franchises, submitted in a written letter to Nascar. She said the pressure of the contract signing demand was problematic.
According to her, Joe Gibbs first attempted to call and talk Nascar out of forcing signatures, but CEO Jim France declined the request.
“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s executives. The response was, “Whether I have 20 charters, that’s what I have. If there are 30, that’s the number.”
