Federal Judge Mandates Release of Abrego Garcia from ICE Custody

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his return to the United States to face alien smuggling charges, he was detained in federal custody.

In her order, the court pointed out that the government lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal challenge center on conflicting claims. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate trial in the state of Tennessee.
